Draft – not legally reviewedThis text is a draft written from the game's actual data processing. It has not been checked by a lawyer yet and is not in force.
Terms of Use
1. Who we are and what these terms cover
Draftborn is offered by Manuel Ennsfellner, sole trader, Gadern 45, 4775 Taufkirchen an der Pram, Austria ("we"). These terms apply to the use of the game, your account and our server. Purchases of Starshards and packs are governed by our Terms of Sale; how we handle data is explained in our Privacy Policy. The terms of Google Play or the App Store apply in addition to the download.
2. The game
- Your hero's progress (gold, items, levels and everything you earn) lives on our server, tied to your account. The game needs an internet connection; without one only the training ground can be played.
- Fights against other heroes look for real players first. When nobody is found, bots fill the empty places; in group runs bots join as allies. Bots always carry the bot symbol. In Ranked matches a bot plays at the rating of its opponent, and bots never appear on a leaderboard.
- The auction house is a market between real players, and guilds are groups of real players (sections 7 and 8).
- Starshards and everything bought with them change only how things look or add comfort (more stash space, more auction slots, more saved loadouts), never the strength of a hero.
3. Age
Draftborn is made for players aged 13 and older. If you are a minor, you need the consent of a parent or guardian where the law requires it, in particular for purchases.
4. Your account
- The account is created the first time the game reaches our server. It has no e-mail address and no password; your phone holds its secret key.
- To move the account and your hero to another phone, use Settings → Account → "Transfer to Another Phone". The transfer code is valid for 24 hours and works once. Keep it to yourself: whoever enters it takes over the account.
- Because we know no contact details, we cannot restore an account whose phone and transfer code are lost.
- One account belongs to one person. Accounts may not be sold, bought, traded or shared.
5. Rules of conduct
Please play fair and respect the other players. In particular it is not allowed:
- to choose a player or guild name, or to write a guild message, that insults, threatens, discriminates, is sexual, advertises, breaks the law or pretends to be someone else (including us);
- to cheat: modified game files or clients, forged requests or run reports, tools that play for you, the use of errors in the game to gain an advantage, or deliberately losing matches to push someone's rating;
- to sell or buy gold, items, goods, heroes or accounts of Draftborn for real money or anything outside the game, inside or outside the game, or to offer such trades;
- to manipulate the auction house, for example by moving gold or items between own or arranged accounts or by trades that only serve to shift value;
- to disturb the server or other players' connections, or to access it in other ways than through the game;
- to misuse emotes, quick messages, invitations or reports to harass other players.
If you find an error in the game, please tell us at info@proofdocs.de.
6. Moderation
- Automatic checks: player names, guild names and guild messages pass a word filter in English and German; a text with a listed word is not accepted. Titles can only come from the game's own list. There is no free text chat; players communicate with emotes and quick messages from a fixed list, and guild masters and officers can set a short guild message.
- Checks of runs: the server checks the reports of runs played on your phone. A report that fails the checks earns no rewards and is shown to us.
- Reports: you can report a player on their profile card (name, behavior or other) and a guild on its page (name, message or other), up to a daily limit, or write to info@proofdocs.de. We read every report and decide by hand.
- Measures: if a name, a guild or behavior breaks these terms, we can reset a player name (to "Hero"; the game then asks for a new one), rename a guild, clear a guild's message, dissolve a guild (its members are told), or suspend an account for a time or permanently. A suspended account is refused at sign-in, so only the training ground can be played, and a connected phone is disconnected; the account is left out of every leaderboard, and its listings in the auction house are held (hidden, not buyable and not running out) until the suspension is lifted. Serious or repeated breaches, in particular cheating and trading for real money, can lead to a permanent suspension. We choose the mildest measure that is enough and take your interests into account.
- Your say: we tell you the reasons for a measure that concerns you, and you can object to it by e-mail to info@proofdocs.de. We review the objection and tell you the result.
- Blocking: you can block any player yourself; they then no longer reach you with friend requests, invitations, emotes or quick messages.
7. The auction house
- In the auction house players sell items and goods to each other for gold, at a fixed price (buyout only). Prices are set by the players; we do not set, check or guarantee them, and a sale cannot be undone.
- Listing costs a fee in gold, shown before you list. A sale costs the seller a share of the price (the house cut), also shown in the game. The fee and the house cut are never returned, also not when a listing is taken back or runs out.
- What you list leaves your hero at once and is held by the auction house until it is sold, taken back or its time runs out. What you buy, the gold from a sale and what comes back unsold wait in your mailbox until you collect them.
- When an account is deleted, by you or automatically after 24 months without a sign-in (which includes a permanently suspended account), the items, goods and gold in its listings and mailbox are lost without compensation. During a suspension the account has no access to them, and its listings are held as described in section 6.
- Only items and goods can be listed; Starshards, Honor, arena gear and looks cannot.
8. Guilds
- A guild is founded for gold. Its master and officers choose its name and its message of the day and are responsible for them; they can invite and remove members as the game allows.
- A guild that breaks these terms can be renamed or dissolved and its message cleared (section 6). A dissolved guild cannot be restored, and the gold paid for founding it is not returned.
9. Ending the use and deleting the account
- You can stop playing at any time. Settings → Account → "Delete Online Account" deletes your account and your hero at once; the page Delete Your Account explains this and the way by e-mail.
- An account without a sign-in for 24 months is deleted automatically.
- With the account, your hero with all its progress, its listings and mailbox in the auction house, its Starshards and everything bought with them are gone for good (see the Terms of Sale).
10. Items and currencies in the game
Gold, Honor, Starshards, gems, items, goods and looks exist only in the game. They have no value in money, cannot be exchanged for money and may only be traded inside the game, as the game allows (section 7). You receive a personal right to use them in the game, not ownership.
11. Changes and availability
- We develop the game further: updates can add, change or balance content, abilities, items, prices in gold and rules. Seasons, the weekly Brawl and events run for a limited time as announced in the game.
- We do our best to keep the server available but cannot promise that it is always reachable, for example during maintenance or faults. Without the server only the training ground can be played.
- Some changes need the newest version of the game; an older version then asks you to update.
12. Rights to the game
All rights to Draftborn (code, art, sounds, music, texts and the name) belong to us or to the licensors named in the game. You may use the game for your own, private purposes. You may not copy, change, decompile or distribute it, except where the law allows it.
You may publish screenshots and videos of the game, for example on streaming and video platforms, also when you earn money with them. Selling the game's material itself (its art, models, sounds, music or texts) or using it outside such pictures and videos is not allowed.
13. Liability
We are liable according to the statutory provisions. Your statutory rights as a consumer stay unaffected.
14. Changes to these terms
If we change these terms, we announce it in the game before the change takes effect. If you do not agree, you can delete your account.
15. Applicable law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live remain in force.
